Regular Meeting #06-06

The Regular Meeting was called to order at 7:30 p.m. by Chairman Wayne Addy

Members present: W. Addy, G. Rockwell, R. Tanko, M. Sanders, R. White

Visitors: Raymond Sanford, Don Carlson, Warren Schumack, Charles Elias

Engineer Charles Elias submitted a revised plan for the Sherwood Forest Subdivision proposed for Route 81. A Planning & Zoning review of the plans resulted in some changes required by other town agencies. The proposed entrance to the subdivision has been changed to meet DOT requirements, resulting in the road being a little farther away from the wetlands. Also, a box culvert, rather than a bridge, is now proposed to cross the wetlands. A motion was made by W. Addy and seconded by R. Tanko that the set of plans “Final Subdivision Plan” Subdivision of land to be known as “Sherwood Forest”, Tax Map 37-Lot #3, dated August 30, 2005, with revisions dated September 8, 2006, September 22, 2006, October 7, 2006, October 25, 2006, February 16, 2006, February 28, 2006 and March 10, 2006, be accepted as amended plans for the current permit; with the condition that the work be done in the July 1st through September 30th construction window as recommended in the March 28, 2006 letter to the commission from Joseph M. Dillon, P.E., Nathan Jacobson & Associates, Inc. The motion carried unanimously.

Minutes: The minutes of the March 14, 2006 Regular Meeting were approved by a
consensus of the members.

Enforcement Officer’s Report: Cathie Jefferson provided information on the following:

She received a call from Michael Fraser. He will get a permit application and apply for an After-the-Fact permit.

Seven new Request for Review forms have been submitted.



OLD BUSINESS

A. Notice of Violation to Ty Wallace – 77 Burr Hill Road
Enforcement Officer C. Jefferson said the workers are back on site and starting to do the work as recommended in the letter from Engineer Roger Nemergut.

B. Notice of Violation to Michael Amato – 92 Parker Hill Road
Maurice Woodworth has been hired to draw up a plan. It has not been submitted to the commission yet.

C. Discussion of IWWC Attorney selection
Discussion was tabled.

D. Town of Killingworth permit application - relocation of Transfer Station and new access road – Route 81
Raymond Sanford, P.E, from TPA design, representing the Town, reviewed the plan for the first phase of the Town Center project. A site walk was conducted on March 25th. Members learned that the proposed pond was designed to the prior best management practices, not the current ones. Members questioned the location of the pond and the road and felt there might be alternatives to the plan that was presented that have lesser impact on the wetlands. Mr. Sanford will discuss the commission’s concerns with his committee and the Land Use Committee. The commission would like to find out if a detention basin is allowed in the wetlands. The DEP (on another project) and the Corps of Engineers (on this project) seem to have differing opinions.

E. Classic Country Homes, LLC (owner), Dennis Bozzuto (applicant) permit application – 142
Little City Road
Members inspected the site on March 25th. Cathie Jefferson informed the members that a permit for this activity had been issued in 2004 to a different property owner. W. Addy moved, seconded by G. Rockwell, to grant a permit, and waive the fee (if they choose) to Classic Country Homes, LLC (owner), Dennis Bozzuto (applicant), for construction at 142 Little City Road, Map 06, Parcel 05D. The motion carried unanimously.

Regular Meeting #06-05

Minutes: The minutes of the February 28, 2006 Regular Meeting were approved by a
consensus of the members.

Enforcement Officer’s Report: Cathie Jefferson provided information on the following:

She has an email address for the transfer of a permit on Lot #43 in The Ridges at Deer Lake. Lots #43 and 44 were purchased together. One driveway will be constructed to a house on Lot #43.

She had a call from the Park & Recreation Commission. There is some concern about runoff from the present compactor site onto the Rocco Reale baseball field. A review form will be submitted. Members will inspect on March 25th after the Town Center compactor relocation site inspection (at approximately 9:30).

The reviews from February were distributed to members.

She inspected the new school site. Members will inspect on Saturday, March 25th.



OLD BUSINESS

Mr. Wallace is working on completing the items on the list of recommendations from Engineer Roger Nemergut that were approved by the Commission.

B. Discussion of IWWC Attorney selection
Discussion was tabled. Cathie Jefferson has responses from surrounding towns on whether they use the same, or a separate attorney, as the Town Attorney.

C. Notice of Violation to Michael Amato – 92 Parker Hill Road
Cathie Jefferson reported that Maurice Woodworth is working on a plan for the work to be done on the Amato property. It will be submitted to the commission when it is ready.

D. Town of Killingworth permit for relocation of Transfer Station – Route 81
Commission members will inspect the site on March 25th at 8:30 a.m.

B. Request for Review forms
No new request forms were submitted since the last meeting. 

C. Classic Country Homes, LLC (owner), Dennis Bozzuto (applicant) permit application – 142
Little City Road (added to the agenda by a vote of commission members)
A motion was made by W. Addy and seconded by J. Himmelman to add this item to the agenda.
The motion carried unanimously. This property was reviewed and approved before the current IWWC regulations were approved. The wetlands setback has been changed from 50’ to 100’ and the proposed septic system is now in the review area. A site walk will be conducted on March 25th at approximately 10:00 a.m. Cathie Jefferson will ask the applicant to stake where the septic system is proposed.

D. Other
Members discussed the Regional Water Company’s presentation to the Board of Selectmen on February 28th. M. Sanders had attended a portion of the meeting. Class 3 property owned by the water company is being put on the market (approximately 150 non-contiguous acres). Members would like to know where this property is located. They will try to find out more information about this proposal.
