Regular Meeting #07-06

March 27, 2007


The Regular Meeting was called to order at 7:30 p.m. by Chairman Wayne Addy.

Minutes: The minutes of the March 13, 2007 Regular Meeting were approved by a consensus of the
members.

Enforcement Officer’s Report: Cathie Jefferson reported on the following:
1. She distributed copies of the Lovers Lane ERT report. She noted that test borings were not done. Commission members would like to see the borings done for additional information.
2. At the request of commission members, she will inspect property on the corner of Stevens Road and Roast Meat Hill Road
3. She will inspect the Patrick Drive area
4. One review form was submitted since the last meeting


OLD BUSINESS

A. Anthony Papa request for permit amendment for Lot 11, Parkside Resubdivision – Patrick Drive
Commission members inspected the site on March 24th. Engineer Roger Nemergut submitted a revised recommended sequence of construction of the proposed driveway. Items have been added related to the driveway prior to construction. It is noted that prior to construction of the driveway, there will be a preconstruction conference onsite with the Wetlands Enforcement Officer, the contractor, and the engineer to review the construction sequence and environmental concerns related to the project.

Phase I and Phase II have been added to the sequence. Phase I includes installing the beaver dam bypass device after June 1st; the beaver dam will be breached in stages to avoid hydraulic overloading and erosion within the existing outlet. Phase II states that, prior to resuming construction, the Wetlands Enforcement Officer and the project engineer will meet with the contractor to inspect the site conditions. No work will be done until the Enforcement Officer gives the authorization to proceed with the activity. The anticipated time frame for the project is July 1 to September 15.

After much discussion on the procedural details of the driveway construction, a motion was made by T. Doyle, amended by W. Addy, and seconded by G. Rockwell to grant a permit amendment to John Fasulo III as shown on the plan “Record Subdivision Map and Site Development Plan, Parkside Resubdivision, Patrick Drive, Killingworth, CT” , Map 28, Lot 40, dated March 10, 2005 with six revisions, the latest one dated 2/21/07, with the following two additional stipulations:
1) an engineer is on site for each breach point of the dam to validate that the flows are consistent with flows that will not cause downstream erosion;
2) test pits be put every 100’ within the wetlands area and that a certified engineer check the test pits prior to activity between the two test pits and approves the activity before it starts for that particular area of the road;
3) the recommended sequence of construction submitted tonight be part of the permit stipulations.
The motion carried unanimously.


B. T. Cost (owner), Killingworth Center, LLC (applicant) permit application for cluster subdivision
and site plan modifications – corner of Route 81 and Chittenden Road
Engineer Michael Harkin discussed three alternatives for the proposed third building on the plan to respond to the commission’s concerns about the wetland impact of that building’s parking area. The first alternative is to leave the building and parking area where they are on the plan, take away the level spreader and the catch basin and put the catch basin in a different location. A storm line would run down the side of the property with a series of manholes, a swale, and the water would discharge into the wetlands near Route 81.

Option 2 would leave the building and parking where they are, leave the level spreader and storm drainage run, but add an oil grit chamber and catch basin inserts, etc. The third option is to flip the building location and put the parking area in front of the building and have the sheet flow go towards Route 81 through a swale and then into the wetlands. The back of the building would be approximately 25’ from the wetlands. A lot of blasting would have to be done for Option 3.

Questions from members elicited discussion on moving or changing the shape of the parking area; relocating one or more buildings; the topography dictating the building location; direction of storm water runoff; required size of water tank; and the channeling of water from each of the buildings. Mr. Harkin stated he will submit a revised plan at the next meeting based on the discussion at tonight’s meeting.


NEW BUSINESS

A. Seven Eighth’s LLC/Brad M. Turley (owner), Brad M. Turley (applicant) permit application for addition to existing indoor riding arena – 70 Route 80
Engineer Roger Nemergut discussed the proposal for an addition to an existing indoor riding arena to be used for storage. There is a wetland area in one corner of the property, but not within the proposed area of activity. Mr. Nemergut said the applicant will be submitting a Special Exception request to the Planning & Zoning Commission. He is requesting that a letter from this commission be sent to P&Z stating that the project has been reviewed.

B. Shirlee Bochanis (owner), Shirlee & Dean Bochanis (applicant) permit amendment application – 183 Route 81
A site plan has been submitted showing just the Bochanis property at 183 Route 81 and the activity on that portion of the Killingworth Commons property. The original permit application encompassed the entire parcel of Killingworth Common with activities for the proposed Cooking Company building as well as proposed new building construction. A new permit application for their section of the property has been submitted. No regulated activities are proposed on the Bochanis property.


C. Papoosha Real Estate Investors, LLC Request for Wetlands Review for greenhouse and retail building at 219 Route 80
Engineer Ed Coppola discussed an application for a wetlands review on a proposal for an addition of a greenhouse onto the existing building. Additional parking area is also proposed. The wetlands were flagged in 2004 when the existing building was constructed, but have not been flagged since then. Some fill will be added and will be approximately 104 feet from the wetland area. Mr. Coppola stated that additional erosion protection will be added. He is requesting a letter be sent from this commission to the Planning and Zoning Commission saying that the proposed plan has been reviewed.
