April 24, 2007


The Regular Meeting was called to order at 7:30 p.m. by Chairman Wayne Addy.

Minutes: The minutes of the April 10, 2007 Regular Meeting were approved by a consensus of the
members.

Enforcement Officer’s Report: Cathie Jefferson reported on the following:
1. She inspected the swale constructed by Mr. Lemelin as discussed at the last meeting and said it looked good.
2. She inspected the Sherwood Forest subdivision site after the heavy rain and found the water running clean.
3. The pond on the Moore was also inspected after the rainstorm and there were no concerns.
4. Nine review forms were submitted since the last meeting


OLD BUSINESS

A. T. Cost (owner), Killingworth Center, LLC (applicant) permit application for cluster subdivision
and site plan modifications – corner of Route 81 and Chittenden Road
Professional Engineer Michael Harkin discussed the revised plans he submitted at the last IWWC meeting.
Members asked about the use of pavers in the parking area to have less impervious surface. Mr. Harkin said there is a potential freezing problem because the surface is so close to ledge. The back part of the driveway will not be regular gravel with fine dust; it will be a gravel type surface with 1” or so of stone that will not compact as much.

Mr. Harkin said the owner of the property is responsible for maintenance and cleanout of the catch basins. There will be a checklist that will be used when any maintenance work is completed. That checklist will be transferred to the new owner if the property is sold.

Mr. Cost answered a question about the location of tractors or other vehicles with small engines saying they will be kept inside a building as much as possible. He said he cannot guarantee that there will never be a tractor outside, but their plan is to keep them inside.

A motion was made by W. Addy and seconded by T. Doyle that the application submitted by Mr. Thomas Cost (owner), Killingworth Center, LLC (applicant), for Olde Church Commons, as shown on the plan “Olde Church Commons Site Plan Modifications” dated January 31, 2007 with a revision date of April 2, 2007, be approved with the following two stipulations:
1) storage of small engines and vehicles upon which there are small engines be limited to areas that
have been paved;
2) the area north of the driveway paralleling Route 81 be brought back to the Commission
before starting work, and after DEP review, to determine an appropriate way of
channeling or holding storm water from that area.
The motion carried unanimously.


B. Lovers Lane Environmental Review Team report
Members discussed the report from the Environmental Review team. C. Jefferson said she spoke with First Selectman Marty Klein about the report. There is no indication whether or not the Town will present a plan for Lovers Lane. Members agreed that there is no easy or cost effective fix for the water problem on Lovers Lane, and probably the solution that is best for the wetlands is to close the road when there is water on it. The wetlands concern is the potential pollution of the water when the cars drive through it.


NEW BUSINESS

A. E. & T. Rogers permit application for deck – 46 Fawn Hill Road
The certificates of mailing from notification to adjoining/abutting property owners were submitted. Mrs. Rogers explained to the commission that they would like to construct a wood composite deck which will be in the wetlands review area. Members agreed that Enforcement Officer Cathie Jefferson will inspect the site and present her findings at the next meeting.

Regular Meeting #07-07

April 10, 2007

The Regular Meeting was called to order at 7:30 p.m. by Chairman Wayne Addy.

Visitors: Michael Harkin, Tom Cost Sr., Tom Cost Jr., Jackie Cost, Bruce Haughwout, Eric Lemelin,
Peg Scofield

1. Bruce Haughwout attended the meeting as requested in a letter from Enforcement Officer C. Jefferson. Mrs. Jefferson had received a complaint that he was filling in a regulated area at 32 Patrick Drive without a permit. Mr. Haughwout stated he was cleaning up the area but told the commission that he would cease the activity in the area near the wetlands.

2. Eric Lemelin had also received a letter from Mrs. Jefferson requesting that he come to the meeting to explain the activity at 204 Roast Meat Hill Road. A complaint had been made about grading and manure storage within 100’ of a wetland or watercourse. Mr. Lemelin presented photographs of the site. He has created a berm of wood chips to help protect runoff into the wetland adjacent to his property and will add additional wood chips to it. He assured the members that no manure will be stored on the property near the wetlands. Mr. Lemelin said the Water Company had inspected the site and mentioned no problems to him.

Minutes: The minutes of the March 27, 2007 Regular Meeting were approved by a consensus of the
members with the following correction: On page two, line 5, the word “two” should be removed
from the sentence.

Enforcement Officer’s Report: Cathie Jefferson reported on the following:
1. She found information in a quarterly newsletter of a court case stating that prior wetlands violations by a person can be a basis for denial of a permit
2. No review forms were submitted since the last meeting


OLD BUSINESS

A. Town of Killingworth, c/o Martin Klein, First Selectman, permit application for replacement
culvert with related activities – Burr Hill Road
Members discussed the proposed Town activity for replacing the culvert on Burr Hill Road. T. Doyle moved, seconded by R. Tanko, to approve the application as submitted. The motion carried unanimously.

B. T. Cost (owner), Killingworth Center, LLC (applicant) permit application for cluster subdivision
and site plan modifications – corner of Route 81 and Chittenden Road
Professional Engineer Michael Harkin discussed the revised plans he submitted at this meeting that he feels addresses the concerns expressed by commission members at the March 27th IWWC meeting. There are five points that Mr. Harkin discussed in detail on the new plan.
Item 1 - the major question from the commission according to Mr. Harkin, was the “flipping” of building #3 to get the parking lot farther away from the wetland area. The parking lot is now in front of building #3 and more toward the east.
Item 2 – the access drive was moved a few feet farther from the wetlands and they “tweaked” the septic system.
Item 3 – stormwater runoff from the parking area is now channeled toward Route 81 and the wetlands pocket that borders Route 81.
Item 4 - the roof leaders from building #3 now discharge toward the Route 81 wetlands instead of toward the west wetland pocket.
Item 5 – the roof leaders from the main building - leaders on half of the building now discharge out to grade, and a 5’ x 5’ modified rip rap pad will be installed.

Mr. Harkin said they looked at the use of pervious and impervious surfaces on the site. They limited sidewalks wherever possible. The main travelways will be impervious areas. Some of the areas he said could not be changed from impervious because of safety concerns (people tripping on gravel, etc.). As it is now, a large portion of the water runoff from the impervious surfaces will drain toward Route 81. In response to a question about pavers, the parking area for the main building will not be changed to pavers because of safety and maintenance concerns.

Other minor revisions include the erosion control plan (different phasing); revisions to the septic system; additional yard drain detail; and foundation and roof leader details. A planting plan is in place in areas that will be disturbed to replace vegetation and to act as a buffer. Members agreed that the revised plan is an improvement on the original plan submitted but they would like time to review all of the changes that have been made on the plan. They discussed the use of pavers and a commercial product (Ecostone) being used in some of the parking areas. They also had a question about who would be responsible for maintenance of the catch basins.

Mr. Harkin said the plans still have to go to the State Health Department and to the Planning & Zoning Commission, the town’s Fire Department and to Dick Leighton. They would like to coordinate the work on this site with the work that will be done at the Route 80/81 traffic circle if the timing works with the town and state agencies that need to approve it.

Tom Cost, Sr. submitted an additional 53 signed form letters supporting the project.



C. Seven Eighth’s LLC/Brad M. Turley (owner), Brad M. Turley (applicant) permit application for addition to existing indoor riding arena – 70 Route 80
Chairman Addy will write a memo to the Planning & Zoning Commission stating there are no regulated activities involved with their current proposal.

D. Shirlee Bochanis (owner), Shirlee & Dean Bochanis (applicant) permit amendment application – 183 Route 81
A new permit application for their section of the property has been submitted. No regulated activities are proposed on the Bochanis property. T. Doyle moved to grant a permit amendment as submitted. E. Auer seconded the motion. The motion carried unanimously.

E. Papoosha Real Estate Investors, LLC Request for Wetlands Review for greenhouse and retail building at 219 Route 80
Chairman Addy will write a memo to the Planning & Zoning Commission stating that the IWWC has reviewed the plan and no regulated activities are proposed.
