Regular Meeting #08-10

June 24, 2008

Chairman John Himmelman called the meeting to order at 7:30 p.m.

Members present: J. Himmelman, G. Rockwell, T. Doyle, E. Auer, S. Mala
Also present - Enforcement Officer C. Jefferson

Members absent: C. Lippert

Visitors: No visitors

Minutes: The minutes of the June 24, 2008 Regular Meeting were approved by a consensus of the members.

Enforcement Officer's Report: Cathie Jefferson reported on the following:
1. See Old Business (A).
2. See Old Business (B).
3. The Town of Madison sent us a copy of their proposed IWWC regulations that they will be voting on. Cathie highlighted a copy of their regulations that show differences in theirs and Killingworth's IWWC regulations if members would like to compare the two towns.
4. No new Requests for Review were submitted.

OLD BUSINESS

A. CT Water Company, c/o C. Gaudino (owner), Connwood Foresters (applicant) permit application
for timber harvest with 5 crossings - Kelseytown Road, Map 38, Lot 4
Enforcement Officer C. Jefferson met with a representative from Connwood Foresters for a site inspection of the proposed wetland crossings in conjunction with the timber harvest on approximately 72 acres on Kelseytown Road. Five wetland crossings are proposed - one temporary bridge and four corduroy crossings; the three larger ones were inspected. Enforcement Officer Jefferson did not see anything that would present a problem or negatively impact the wetlands. T. Doyle moved, seconded by E. Auer, to grant a permit for the timber harvest. The motion carried unanimously.

B. M. Young (applicant) permit application - beaver dam on Roast Meat Hill Road
Cathie Jefferson received the permit application that has been signed by First Selectman Richard J. Cabral. The property where the beaver baffle will be installed is property that is owned by the Town. Michael Young had signed the application as the applicant and will coordinate the project. A motion was made by T. Doyle and seconded by G. Rockwell to approve the application for the installation of a beaver baffle on Roast Meat Hill Road. The motion carried unanimously. Members agreed that there will be no fee because it is a Town approved project.

C. Violation at 65 Paper Mill Road
Enforcement Officer C. Jefferson talked with Engineer Edward Coppola about the erosion problem and road washout on Paper Mill Road. Mr. Coppola will be the engineer for the property owner. He will attend the next meeting to discuss a proposed solution for the problem.

NEW BUSINESS

B. Requests for Review
None

C. Wettish property proposal (added to the agenda by a vote of members)
G. Rockwell moved, seconded by S. Mala, to add this item to tonight's agenda. The motion carried unanimously. Eric Auer presented an informal preliminary plan for four fields to be constructed on the Town owned Wettish property. A storm retention and detention basin is proposed to eliminate water runoff from the site. The project will encompass approximately 20 acres; 10 acres of which is land that will be cleared. A drainage system is proposed for the upper fields. The project is not completely designed yet and the committee is looking for input from the various commissions. Enforcement Officer C. Jefferson said this present plan has the least wetland encroachment of any of the previous plans that have been discussed. Members will have conduct a site walk on July 12th at 8:00 a.m.

Chairman John Himmelman called the meeting to order at 7:30 p.m.

Visitors: John O'Donnell, Michael Young

Michael Young of 272 Roast Meat Hill Road presented information about a beaver dam that has been built in the wetland at Roast Meat Hill Road and the old Wolf Hollow Road. The beavers have dammed the spillway and created a 20 acre pond. It has been torn down several times but the beavers rebuild it each time. Mr. Young lives on the property downstream from the dam. He gave information about a beaver "baffle" that can be installed that puts a pipe through their dam and a cage at the end that prevents the pipe from being clogged. Mr. Young met with Skip Hillager, the "beaver buster" person, who installs the baffles. Mr. Hillager said there is a two-stage process of installing pipes to keep an adequate flow of water at all times. The property is town-owned property. Mr. Young will submit a permit application as the applicant, and Chairman Himmelman will discuss it with First Selectman Richard Cabral to ask if he will sign the application as the property owner. Because a septic system in the area is being flooded, commission members voted to issue an emergency permit. G. Rockwell moved, seconded by S. Mala, to approve an emergency permit provided First Selectman Richard Cabral signs the permit application.

Minutes: The minutes of the May 27, 2008 Regular Meeting were approved by a consensus of the members.

Enforcement Officer's Report: Cathie Jefferson reported on the following:
1. She had a discussion with Engineer Ed Coppola about the Reservoir Road bridge replacement. A DOT permit has been issued and now a DEP permit is needed. Cathie said that if the DEP is handling the permits, probably a local IWWC permit will not be needed. Members agreed that they would like to see the plan when it is completed.
2. Five new Requests for Review were submitted.
3. May's building permit list was distributed.

OLD BUSINESS

Enforcement Officer C. Jefferson has not yet met with a representative from Connwood Foresters. John O'Donnell, from Connwood Foresters, acting as an agent of the CT Water Company, presented the proposal for the proposed timber harvesting on 72 acres on Kelseytown Road. Five wetland crossings are proposed - one temporary bridge and four corduroy crossings. Certified letters were sent by Mr. O'Donnell to the neighboring property owners of this property. The project has not yet gone out to bid but he anticipates that the purchasers will have 18 months to complete the work. Members would like C. Jefferson to inspect the site before they act on the application.

B. Codification of Regulations
Town Clerk Linda Dudek needs the commission to vote on the codification of the IWWC regulations for the town. A town meeting will be held this week to vote on the process. When the process is complete, all regulations for all town commissions will be in one binder. Two minor changes in the regulations were pointed out by Chairman Himmelman. Other than those two changes, the only difference will be the renumbering of the regulations. Any changes that are made in the future to our regulations will have to be submitted to the Town Clerk to be changed in the book of town regulations. A motion was made by T. Doyle and seconded by C. Lippert, to approve the codification of the regulations by the Town of Killingworth. The motion carried unanimously.

C. Reid pond clean-out - 159 Green Hill Road
Several commission members looked at the pond that the Reids would like to clean out. T. Doyle expressed concern about where the silt taken out of the pond will be put. He said there is a decent wetland on the north end of the pond and hopes they would avoid dumping anything there. J. Himmelman said that Mr. Reid told him the spoils will be put on the other side of the pond. G. Rockwell moved, seconded by T. Doyle, that the commission will treat this as a review but send a letter to the applicants informing them that they have permission to do the work provided that none of the spoils are deposited in the adjacent wetland area north of the pond. The motion carried unanimously.
