Regular Meeting #08-14

August 26, 2008

Chairman John Himmelman called the meeting to order at 7:30 p.m.

Members present: J. Himmelman, T. Doyle, E. Auer, C. Lippert
Also present - Enforcement Officer C. Jefferson

Members absent: G. Rockwell, S. Mala

Visitors: Walter & Cindy Adametz, Anthony Uzwiak
Anthony Uzwiak attended the meeting after receiving a letter a few weeks ago about work he was doing in the wetlands on his property at 33 River Road. He explained that he has been cleaning up his property that was not maintained for quite some time. Grapevines, roses, etc. have taken over and become very overgrown. Mr. Uzwiak said he has been cleaning up the area using a shovel and axe and pick, but no machines. He said that damage from the beavers has raised the water table and there are now many dead trees in the water. He would like to improve the appearance of the property and asked that the commission give him some direction and guidelines of what he can and cannot do in the area. Mr. Uzwiak will complete a Request for Review form to allow commission members to inspect his property. A site walk will be conducted on Saturday, September 13th at 8:00 a.m.

Minutes: The minutes of the August 12, 2008 Regular Meeting were approved by a consensus of the members.

Enforcement Officer's Report: Cathie Jefferson reported on the following items:
1. A list of building permits for the month of July were distributed.
2. She noted that letters to and from Cardinal Engineering Associates and the CT DEP re: the Reservoir Road bridge mitigation plan have been submitted to this commission
3. A new set of plans for the Wettish property fields will be submitted at the next meeting. The same set of plans will also be submitted to the Planning & Zoning Commission.

OLD BUSINESS

A. Town of Killlingworth permit application for field construction on the Wettish property - Parker
Hill Road Ext.
No new information was submitted at this meeting. Discussion was tabled until the next meeting.


B. W. & C. Adametz permit application for farm pond - 187 Schnoor Road
Some of the commission members looked at the site of the proposed farm pond. There was a lengthy discussion about the placement of the spoils when the pond is dug. Members do not want the material to be piled in the wetland area. Mr. Adametz explained that the material could be spread on much of the area around the pond except for the area to the south of the pond. A motion was made by E. Auer, and seconded by T. Doyle, to approve the plan as presented and grant a permit. Discussion: The area to the south of the pond is to be preserved - there is to be no fill, no stockpiling, and no activity in that area. The motion carried.

NEW BUSINESS

A. Discussion of Lovers Lane - First Selectman Richard Cabral
No one attended tonight's meeting to discuss any proposal for Lovers Lane. Chairman J. Himmelman contacted Brian Golemboski of the Department of Environmental Protection in anticipation of a discussion of Lovers Lane. Any plan proposed by the Town will have to be approved by D.E.P. It is anticipated that the Army Corps of Engineers will be involved in any plans for improvement of that road. Enforcement Officer C. Jefferson requested that Wendy Goodfriend be included in any proposed plan.


B. Adoption of Codified Regulations of Inland Wetlands & Watercourses Regulations of the Town of
Killingworth
A Public Hearing was held tonight at 7:15 p.m. on the proposed Codification of the IWWC Regulations. There were no visitors and no additional information added by commission members. T. Doyle moved to adopt the Codified Regulations as proposed. C. Lippert seconded the motion. The motion carried.

August 26, 2008 Public Hearing


The Public Hearing on the proposed Adoption of the Codified Regulations of the Killingworth Inland Wetlands and Watercourses Regulations was called to order at 7:15 p.m. by Chairman John Himmelman.

Members present: J. Himmelman, T. Doyle, E. Auer, C. Lippert
Also present: Enforcement Officer C. Jefferson and Clerk Mary Anne Lisk

Members absent: G. Rockwell, S. Mala

Visitors: none

The Legal Notice was read and it was noted that it was published in The Hartford Courant on August 13, 2008 and August 19, 2008.

The proposal, if adopted, would codify the Inland Wetlands & Watercourses Regulations of the Town of Killingworth and amend Section 470-32A of the Code of the Town of Killingworth to delete the reference to 22a-42b of the statutes, which section was repealed in 2003. Section 470-42A (3) (d) would be amended to change "Health Officer" to "Director of Health".

Chairman John Himmelman called the meeting to order at 7:30 p.m.

Visitors: Ed Coppola, Walter & Cindy Adametz

Walter Adametz approached the commission about construction of a farm pond on his property at 187 Schnoor Road.


Minutes: The minutes of the July 22, 2008 Regular Meeting were approved by a consensus of the members.

Enforcement Officer's Report: Cathie Jefferson reported on the following items:
1. She noted that there was correspondence from Cardinal Engineering on new hydraulic and drainage structures for the Reservoir Road bridge.
2. She is monitoring the Paper Mill Road enforcement action. The Town has issued a temporary driveway permit. No problems have been seen at the site.
3. At 117 Burr Hill Road, the driveway was being crushed; a construction entrance was put in and the site is okay at this time.
4. Cathie received an email from Nathan Jacobsen Associates regarding the Burr Hill Road culvert. The company doing the work was not doing everything that they said they were going to do but the company has been contacted and all work has been completed to Cathie's satisfaction.
5. Three new Request for Review forms have been submitted since the last meeting.

OLD BUSINESS

A. D. Tyler permit application for driveway with utilities - 119 Roast Meat Hill Road
Engineer Ed Coppola reviewed the revised plan for construction of a new house, garage and storage barn. The existing house will be taken down when the new house is complete. Construction of the driveway is the regulated activity on the site. Members did not have any concerns about the project as presented. A motion was made by E. Auer and seconded by S. Mala, to accept the application as submitted and grant a permit. The motion carried unanimously.

NEW BUSINESS

A. Town of Killlingworth permit application for field construction on the Wettish property - Parker
Hill Road Ext.
A permit application, including a set of construction plans, has been submitted to the commission for their review. The drainage flow from each of the proposed fields, and the retention area, was discussed. Approximately ten acres of trees will be cleared for the field construction. The proposed driveway will be ¾" processed stone. J. Himmelman noted that the vernal pool shown on the map is not a vernal pool. He has walked the site and inspected that area. Members will continue discussion at the next meeting.
