September 23, 2008

Chairman John Himmelman called the meeting to order at 7:30 p.m.

Members present: J. Himmelman, T. Doyle, G. Rockwell, E. Auer, C. Lippert
Also present - Enforcement Officer C. Jefferson

Members absent: S. Mala

Visitors: None

Minutes: The minutes of the September 9, 2008 Regular Meeting were approved by a consensus of the members.

Enforcement Officer's Report: Cathie Jefferson reported on the following items:
1. She said that the DEP will be giving a general permit for the Reservoir Road bridge. The Department of Transportation is looking for a permit or approval from this commission. A representative from Cardinal Engineering will give the commission a brief overview of the work that will be done on the bridge.
2. She reported on a recent court case that said a wetlands commission doesn't have the right to deny a timber harvest. Members of this commission would like all applicants for a timber harvest to present plans in order to make sure the wetlands will be protected during the harvest.
3. The Killingworth Code of Regulations has been completed. It is available online for anyone to see - the website is www.generalcode.com; click on Killingworth. Town Clerk Linda Dudek will take individual sections of the code for various commissions to make copies of.
4. Six new Requests for Review were submitted.

OLD BUSINESS

A. Town of Killingworth permit application for field construction on the Wettish property - Parker
Hill Road Ext.
A revised set of plans, with some minor changes, was submitted to the commission for their review. The location of the fields and the drainage remained the same. Soil types were added to the plan as well as details of the detention basin. A motion was made by T. Doyle, seconded by G. Rockwell, to approve the application as presented in the revised set of plans. The motion carried.

B. A. Uzwiak - 33 River Road
A site inspection was conducted on September 20th. Mr. Uzwiak has cleared out a lot of the overgrown bushes and vines on the property and he indicated some trees that he would like to cut. Members agreed that he will have to submit a permit application for any activity in that area


C. R. & S. Chasse permit application - 3 Saddlebrook Drive
A site inspection was conducted on September 20th. The proposed barn will not be used for housing animals. E. Auer moved, seconded by G. Rockwell, to grant a permit for barn construction with the stipulation that the concrete floor be pitched away from the wetlands. The motion carried.

Visitors: First Selectman Richard Cabral, Scott Chasse

Minutes: The minutes of the August 26, 2008 Regular Meeting and the August 26, 2008 Public Hearing were approved by a consensus of the members.

Enforcement Officer's Report: Cathie Jefferson reported on the following items:
1. She had a call from someone at the Army Corps of Engineers looking for a local permit for the work on Reservoir Road bridge. Cathie talked with Ed Coppola about it. Mr. Coppola said the DEP is only giving a permit for a portion of the activities. A local permit may be applied for.
2. Paper Mill Road overflowed from the property that Cathie has been monitoring. The owner may have to do additional work on the site. Cathie will continue to monitor.

OLD BUSINESS

B. A. Uzwiak - 33 River Road - site inspection on 9/13/08
Members agreed to change the date of the inspection to Saturday, September 20th at 8:15. Mr. Himmelman will contact Mr. Uzwiak.

NEW BUSINESS

A. Discussion of Lovers Lane - First Selectman Richard Cabral
First Selectman Richard Cabral attended the meeting to discuss possible action on Lovers Lane to lessen the flooding of the road. The Town would like to put in four or five pipes that are18"-24" in diameter. A small section of the road would be raised slightly to prevent flooding on the road. No application has been sent at this time to either the DEP or the Army Corps of Engineers. When culverts were discussed several months ago, there was a site walk with members of DEP, Army Corps of Engineers, the Town Engineer, and members of this commission. G. Rockwell had a copy of a memorandum that resulted from that meeting and read portions of it. Cathie Jefferson noted that Town Engineer Howard Pfrommer has the application for culvert installation that was discussed at a meeting of this commission several months ago and suggested that Mr. Cabral discuss it with Mr. Pfrommer. This commission cannot take any action because any application from the Town has to be submitted to the DEP and the Army Corps of Engineers.

E. R. & S. Chasse permit application - 3 Saddlebrook Drive (added to the agenda by a vote of commission members)
J. Himmelman moved, seconded by T. Doyle to add this application to the agenda. The motion carried unanimously. The application was submitted while Enforcement Officer C. Jefferson was on vacation. Mr. Chasse explained his proposal for construction of a 22' x 24' one and a half story post and beam barn and attached lean-to. When his house was constructed, the setback was 50' but it has been changed to 100'. No tree removal is necessary. The existing garden and part of a stone patio will be removed to put in the building. A site inspection will be done on September 20th, after the Uzwiak site walk. Mr. Chasse will stake out the area of the proposed barn.
