Chairman John Himmelman called the meeting to order at 7:30 p.m.
Members present: J. Himmelman, T. Doyle, G. Rockwell, S. Mala, E. Auer
Enforcement Officer C. Jefferson was also present.
Members absent: C. Lippert
Visitors: Anthony Sansone, Roger Nemergut, Fred Dudek, Walter Adametz, Paul Lambert, Cathy Iino
Minutes: The minutes of the July 14, 2009 Regular Meeting were approved by a consensus of the
members.
Enforcement Officer's Report: Enforcement Officer C. Jefferson reported on the following:
1. All of the erosion and sediment controls are not in yet in the Reservoir Road bridge area. She will continue to monitor the project.
2. She is continually getting reports on the condition and progress of the Wettish property field construction.
3. She has spoken with Engineer Edward Coppola about the former Pharmedica property and its owner, Eugene Gargiulo. Mr. Gargiulo has indicated he would like to cut trees in the area to prepare the site for building. Cathie Jefferson will provide commission members with additional information as it is available.
4. A list of building permits for the month of July was distributed to members.
OLD BUSINESS

NEW BUSINESS
A. Lovers Lane paving
Town Foreman Walter Adametz and Selectman Fred Dudek presented information about the proposed plan to "shim, level, and overlay" the road surface on Lovers Lane. A first coat of paving would be done to fill in the existing holes and then an overlay would be put on top of that. Mr. Adametz stated that it has been approximately 26 years since the road was last "coated". He said it would take about two days to complete the project, but it cannot be started until the road is dry. Mr. Himmelman said he would like the commission to work with the Board of Selectmen to improve the road. The majority of the members agreed that the process described to them is acceptable for road improvement.
B. M. & K. Milano & Milano Family Trust Application for Review for 2-lot subdivision
An application had been previously submitted for a 6-lot subdivision. A new Application for Review has been submitted for a two-lot subdivision. Paul Lambert, of Lambert Engineering, explained that a report from the Soil Scientist who reviewed the property said there were no wetlands on the section of the property that encompasses the two proposed lots. Chairman John Himmelman will write a letter to the Planning & Zoning Commission stating that the application, as proposed, will have no wetlands impact.
C. Buchanan Family LLC (J. Robert Buchanan) permit application for WL crossing - Chestnut Hill
Road
Engineer Roger Nemergut presented plans for a wetland crossing over an intermittent watercourse to access a house site on a 42 acre parcel of land on Chestnut Hill Road. A recent lot-line revision of the property was done. Mr. Nemergut explained that the owner is trying to obtain a permit for the crossing to make the property more saleable, but he is not proposing to build a house at this time. The owner proposes to offer fifteen acres of the lot to the Killingworth Land Trust. Mr. Nemergut will contact the Land Trust to ask if they will have someone write a letter to this commission expressing their desire to accept the Open Space land. Commission members did not express any concerns about this proposal. It will be voted on at September 8th meeting.
D. Notice of Violation sent to Anthony Sansone
A Notice of Violation, dated August 4, 2009, was sent to Mr. Sansone after a neighbor's complaint of construction of an access way and raised platform abutting the Sansone property adjacent to Kroupa's Pond. Mr. Sansone attended the meeting and explained that he wanted to put a dock in the water for his family members to fish from. Mr. Sansone said he did not know that the area was a regulated area and he needed to apply for a permit for that activity. Commission members will inspect the site on Tuesday, August 25th at 5:30 p.m.
