Regular Meeting #09-12

November 10, 2009

Chairman John Himmelman called the meeting to order at 7:30 p.m.

Members present: J. Himmelman, T. Doyle, G. Rockwell, E. Auer, C. Lippert, S. Mala

Members absent: Enforcement Officer C. Jefferson was absent.

Visitors: Peter & Ellen Baecker, Roger Nemergut, Mike Bugbee, Corde Ewers, Mr. & Mrs. F.Austin

Minutes: The minutes of the October 13, 2009 Regular Meeting were approved by a consensus of the
members.

Enforcement Officer's Report: Enforcement Officer C. Jefferson emailed members noting that she had not received any additional information on the Sansone application, and gave a report on the dewatering process at the Reservoir Road bridge.

OLD BUSINESS

A. A. Sansone permit application for dock - 347 Route 148
A permit application has been submitted for construction of a dock on Kroupa's Pond. According to the site plan dated July 27, 1994, that was submitted with the application, the Sansones do not own any portion of the pond adjacent to their property. Members agreed that a permit cannot be granted due to the ownership situation. No additional information was submitted at this meeting. MOTION, T. Doyle; SECOND, C. Lippert: that the permit application submitted by Anthony Sansone for a dock on Kroupa's Pond at 347 Route 148 be denied because the application is incomplete - it has not been signed by the landowner or an agent of the landowner, and proof of ownership of that portion of the property has not been established. Yes (5) T. Doyle, G. Rockwell, C. Lippert, E. Auer, S. Mala. No (0) Abstain (0)
The motion carried.

B. P. & E. Baecker permit application for house addition - 79 Bar Gate Trail
Members inspected the site of the proposed addition on Saturday, October 17th. Contractor Mike Bugbee explained that the adjacent stream will not be disturbed because of the construction. Silt fencing or hay bales will be used to minimize erosion and sedimentation. Some of the spoils will be used on the property to fill in some low spots and some will be trucked off the site. MOTION, T. Doyle; SECOND,
G. Rockwell: that the permit application submitted by Peter and Ellen Baecker for enlargement of an existing bedroom, bathroom and hall at 79 Bar Gate Trail be approved and a permit be granted.
Yes (5) T. Doyle, G. Rockwell, C. Lippert, E. Auer, S. Mala. No (0) Abstain (0) The motion carried.

NEW BUSINESS

A. F. Austin review application for new house & related improvements - 241 River Road
An Application for Review has been submitted for a new house with improvements located at 241 River Road. Engineer Roger Nemergut presented the plan and explained that the existing house, well and septic system will be removed. A new three-bedroom house will be built, a new septic system will be installed and a new well will be dug. Mr. Nemergut would like commission members to inspect the site before a permit application is submitted. Members will inspect the site on Saturday, November 28th at 8:30 a.m.

B. Slate of officers for 2010
The following slate of officers was proposed:
Chairman - Gaylord Rockwell
Vice-Chairman - Terry Doyle
Secretary/Treasurer - Sheryl Mala
MOTION, E. Auer, SECOND, C. Lippert: that the proposed slate of officers for 2010 be approved.
One vote in favor of the complete slate of officers was cast by Secretary/Treasurer Gaylord Rockwell.


C. Meeting schedule for 2010
There was a consensus of the members that the meeting schedule will remain as it is this year - meetings will be held on the second Tuesday of each month.

The motion carried.
A proposed Eagle Scout project of construction of a sign for "Parmalee Farm" was discussed. An Application for Review has been submitted for the project. The sign will consist of two posts with a roof over it. According to the information on the submitted application, the structure will be more than 100' from the wetlands so no permit application is needed.
