Regular Meeting 899

1. Call to Order
Chairman Lentz called the meeting to order at 7:30 PM.

2. Minutes of Regular Meeting No. 898 Held September 19, 2006
Motion by Morgan, second by Hayash, to approve the September 19, 2006 Minutes as written. PASSED UNANIMOUSLY.

3. Visitors - none.

4. Communications and Bills
(1) Special Exception Application #216, Village East, Lot 1.

(2) Special Exception Application #217, Village East, Lot 2.

(3) Special Exception Application #218, Reservoir Road Accessory Apartment.

(4) Subdivision Application #307.

(5) Board of Selectmen Minutes from September 11, 2006.

(6) Technique Printers Invoice for Printing of Zoning Regulations.

(7) Letter from Connecticut Water Company asking applicants to notify them of projects in the Watershed Area.

6. Zoning Enforcement Officer's Report
(a) C. Jefferson noted the Complaint was served last week to Chris Lundberg. It was combined with a complaint from the Health Department also.

(b) C. Jefferson noted the road was paved at Cranberry Lane. Wetlands has looked at it because they want to have the Open Space turned over to the Land Trust and the wetlands crossing had to be completed.

(c) C. Jefferson reviewed the letter from The Water Company which coincides with the newest State Statute that requires (as of October 1, 2006) that applicants notify not only The Water Company but also the Connecticut Health Department. This also applies to property in the Aquifer Protection area. The Aquifer Protection Area Map is on the wall in the Zoning Office. Applicants can file these on line with the State Health Department.
(d) C. Jefferson noted she found the original Memorandum of Decision (July 2, 1980) for the old Bronco's Café and condition #4 says that the public entrance be located facing the interior of the Shopping Center.

(e) September Permit Log was distributed.

(f) C. Jefferson noted the road is being put in for the Sherwood Forest Subdivision.

(g) C. Jefferson was asked to send CL&P a letter to adjust the lighting at the Killingworth Village.

(h) There was discussion about how long a Subdivision Sign can remain. C. Jefferson noted State Statutes allow for five years. The Surrey Ridge Subdivision is a private road. C. Jefferson will check the regulations to see if there is time limitation as to how long these signs can remain.

7. New Business
(a) Special Exception #216 - Village East Lot #1 Route 81 - Commercial Buildings - Owner Ronald & Rosalie Amato
(b) Special Exception #217 - Village East Lot #2 Route 81 - Commercial Buildings - Owner Ronald & Rosalie Amato
(d) Sudivision Application #307 - 2 Lot Subdivision Property on Route 81, Owned by Ronald & Rosalie Amato

Edward Coppola represented the applicants in the above 3 applications. Mr. Coppola noted he was before the Commission on August 15th with a preliminary plan and this is basically the same with no change in the concept. He just changed a couple of things that were mentioned at that meeting. Mr. Coppola pointed out the location of the property which is 4.68 acres. The property lies in 2 zones - residential and commercial. He highlighted the zone line. All the work proposed is in the commercial zone. There is a wetland area to the rear. Two lots are proposed with a driveway cut off Route 81. He reviewed the 3 buildings, the parking area, sidewalks, the disturbed areas that would be landscaped. Mr. Coppola reviewed the fire protection which he reviewed with Richard Leighton, Code Official. Lot 1 has 2.11 acres of which 1.17 is commercial. Lot 2 has 3.75 acres of which 1.26 is commercial. Location of driveways was reviewed. Mr. Coppola noted an application has been submitted to the Wetlands Commission. He reviewed drainage from Route 81 and through the site. Mr. Coppola reviewed the well on each lot. He noted the use of the buildings are not known at this time but would be retail or professional offices. Plans have been submitted to the Town Code Official, Town Engineer and Conn. DOT. Mr. Coppola reviewed building elevations. Chairman Lentz asked why this was a subdivision if it has only 2 lots. Mr. Coppola noted this already had a free split so this would be subdivision. Chairman Lentz noted a public hearing is required for the Special Exceptions, but not the Subdivision. The number of parking spaces and employees was reviewed.

Mr. Coppola will return at the next meeting with additional information.

(c) Special Exception #218 - 222 Reservoir Road Accessory Apt. - Owner June Sullivan
A public hearing was scheduled for November 21, 2006. This was an existing apartment where a parent had lived there who is now in a nursing home. It has been there for 10 years and they would like to turn it into an accessory apartment. There is no new construction. C. Jefferson noted it meets the regulations, but a report is required from the Code Official regarding sanitation.

8. Report of Officers and Subcommittees
(a) Updates of Town Plan of Conservation & Development
Jere Adametz, CRERPA representative, noted there has been no progress regarding the Land Use Table.

Chairman Lentz distributed copies of Chapter 1 of the Plan of Conservation & Development. Chapter 5 will be copied and distributed at the next meeting. Mr. Lentz suggested everyone review Chapter 1 and submit any comments.

The questionnaire was reviewed.
