Ordinance Regarding Private Drinking Water Supply Testing
For New Residential Construction

 

 

WHEREAS, Connecticut General Statutes Section 19a-37 provides that a certificate of occupancy for new residential construction may be withheld on a basis of a water quality test on a private residential well if such test results indicate that any maximum contaminant level applicable to public water supply systems for any contaminant listed in the public health code has been exceeded; and

WHEREAS, the Town of Killingworth wishes to minimize the possibility of economic loss to prospective homeowners and others that could occur should a new private residence be constructed prior to confirmation that a new private residential well that meets the requirements of the public health code be installed;

NOW THEREFORE, it is hereby

RESOLVED:

1. That an applicant for a building permit for a new residential dwelling shall provide, as a part of the application for said permit, a water quality test on a private residential well installed on the premises pursuant to a well permit issued by the appropriate authority in accordance with the requirements of the Public Health Code and other regulations issued by the Commissioner of Public Health, indicating that no maximum contaminant level applicable to the public water supply systems for any contaminant listed in the public health code had been exceeded.

2. The results of all required water tests shall be filed with the Director of Health, and all tests required by this ordinance shall be conducted by a laboratory approved by the Commissioner of Public Health.
